Terms of Use (EULA)

1. License agreement

CabForward ("the app") is licensed, not sold, to you. Your license to use the app is governed by Apple's Licensed Application End User License Agreement (the "Standard EULA"), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. By downloading or using CabForward, you agree to the Standard EULA together with the additional terms on this page. Where there is any conflict regarding subscriptions, the terms on this page apply.

2. CabForward Pro & subscriptions

CabForward is free to use for core features. CabForward Pro unlocks the full app and is available through the following In-App Purchases:

• CabForward Pro — Monthly: an auto-renewing subscription billed every month.
• CabForward Pro — Annual: an auto-renewing subscription billed every year.
• CabForward Pro — Lifetime: a one-time, non-recurring purchase that does not auto-renew.

The title, exact length, and current price of each option — in your local currency — are shown on the purchase screen within the app before you confirm any purchase.

Billing & auto-renewal

• Payment is charged to your Apple Account upon confirmation of purchase.
• Auto-renewing subscriptions automatically renew at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your Apple Account is charged for renewal within 24 hours prior to the end of the current period.
• You can manage your subscription and turn off auto-renewal in Settings → [your name] → Subscriptions on your device after purchase.

Cancellations & refunds

Cancelling stops future renewals; the current period remains active until it ends. All purchases are processed by Apple, so refund requests are handled by Apple in accordance with its policies at reportaproblem.apple.com.

3. Logo Studio & AI-generated content

Logo Studio is an optional feature that creates a custom railroad herald. When you generate a logo, the railroad name, tagline and design choices you enter are sent through our backend to our AI image-generation partner, Ideogram, which creates the image. Ideogram's own Terms of Service and Privacy Policy govern its handling of that request; see our Privacy Policy for what we send it.

• Ownership. As between you and us, you own the logo images you generate, consistent with Ideogram's terms, under which it assigns to the requesting party all right, title and interest it may hold in generated output.
• No uniqueness or accuracy warranty. Because of how generative AI works, a generated logo may not be unique — other users entering similar design choices may receive a similar image. We make no warranty about the accuracy, originality, or fitness of any generated logo for trademark or commercial use, and you are responsible for confirming you have the right to use it, including any trademark clearance.
• Credits. Logo generations are purchased as a consumable in-app credit, individually or bundled with CabForward Pro. A credit is spent only after a successful generation; failed generations are not charged.
• Acceptable prompts. Don't enter a railroad name, tagline or design description that is unlawful, infringing, hateful or otherwise violates Ideogram's acceptable-use terms. We may decline a request or restrict access to Logo Studio for misuse.

4. Privacy

Your use of CabForward is also subject to our Privacy Policy, which explains how the app handles information. CabForward is local-first and does not collect personal data on our own servers.

5. Sharing & Multiplayer

The optional Sharing & Multiplayer feature lets you invite another operator to run your railroad with you, or join a railroad someone else shares with you, using Apple's iCloud sharing. See our Privacy Policy for how this works.

• You control what's shared. You choose whether an invited operator can edit everything (Full Crew), watch only (View Only), or edit specific areas (Custom), and you can revoke their access at any time.
• You're responsible for what you share. Only invite people you trust with your railroad content, and think carefully before using the "Anyone with the link" option, since anyone who obtains that link can join.
• Respect other operators' railroads. When you join a railroad shared with you, only make the changes the owner has permitted, and don't use their content for anything outside operating together in CabForward.
• We're not a party to your sharing arrangements. CabForward provides the feature; we are not responsible for disputes between operators over shared railroad content, or for a participant's conduct.

6. Acceptable use

CabForward controls model railroad equipment over your local network. You are responsible for operating your layout safely and in accordance with your hardware manufacturers' instructions. Do not use the app in any unlawful manner or in a way that could damage equipment or cause injury.

7. Disclaimer & limitation of liability

The app is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law and as further described in the Standard EULA. CabForward is an independent project and is not affiliated with, endorsed by, or sponsored by the DCC-EX project, Apple Inc. or Ideogram. To the extent permitted by law, the developer is not liable for any indirect, incidental, or consequential damages arising from your use of the app, including damages arising from AI-generated content produced by Logo Studio.

8. Changes to these terms

We may update these Terms of Use from time to time. When we do, we'll revise the "Last updated" date above. Your continued use of CabForward after an update means you accept the revised terms.
